⚡ Quick Answer

What is Trademark Registration in India?

Trademark registration in India is the official legal process of protecting your brand name, logo, tagline, or symbol under the Trade Marks Act, 1999. Once registered, no other business in India can legally use a similar mark for the same category of products or services. The process is managed by Intellectual Property India (IP India) under the Ministry of Commerce and Industry. A registered trademark is valid for 10 years and can be renewed indefinitely — giving your brand permanent protection.

Registration gives you the exclusive legal right to use the ® symbol, sue for infringement in court, sell or license the mark, and build a strong, recognizable brand identity. Government fees start at ₹4,500 per class for individuals, startups, and MSMEs (50% concession).

Understanding Trademark

What is Trademark Registration?

Your brand name, logo, and tagline are the face of your business. They tell customers who you are. Trademark registration means legally protecting that face — so no one else can copy it or take credit for your hard work.

Think of it this way: if you have built a brand and someone else copies your name or logo, without trademark registration you have very limited legal options. But once your trademark is registered, you can directly approach the court, file an infringement case, and even claim damages. Under Section 29 of the Trade Marks Act, 1999, a registered trademark holder can seek injunction, damages, and delivery of infringing goods — giving you powerful tools against imitators.

Logo registration works the same way as word trademark registration — your logo or design is filed as a "device mark" with the Trademark Registry. Once registered, that unique visual identity is entirely yours, legally protected across all 45 trademark classes in India. You can file in black & white (covers all color variations) or claim specific color combinations.

DMS Legal World, based in India, has helped 500+ individuals, startups, and businesses with their trademark registration services. Our team of IP experts handles every step — from conducting a comprehensive trademark availability search to ensuring your certificate is issued without delays.

Expert Knowledge

Trademark Objection, Opposition & Renewal — Complete Guide

What is a Trademark Objection?

After filing your trademark registration application, the Trademark Examiner may issue an Examination Report — commonly called a trademark objection. This happens when the examiner finds your mark to be similar to an existing registered mark, or finds it descriptive, or lacking distinctiveness.

An objection does NOT mean your trademark is rejected. You have 30 days to file a written reply explaining why your mark should be registered. DMS Legal World's team prepares a strong, legally backed reply to overcome objections. In most cases, properly drafted replies are successful. If needed, we also represent you at the hearing before the Registrar.

What is Trademark Opposition?

After your trademark is published in the Trade Marks Journal, any third party has 90 days to file an opposition (Form TM-O) against your application. This usually happens when an existing brand owner believes your mark is too similar to theirs.

If opposition is filed, a counter-statement must be submitted within 2 months. DMS Legal World handles opposition proceedings professionally — drafting counter-statements, filing evidence affidavits, and representing you before the Registrar until the matter is decided in your favour.

Trademark Renewal — Don't Let Your Mark Lapse

A registered trademark in India is valid for 10 years from the application date. It must be renewed every 10 years by filing Form TM-R with the prescribed renewal fees. Renewal can be filed up to 1 year before the expiry date — and even up to 6 months after expiry (with a late fee surcharge).

If you miss renewal, your trademark enters a "lapsed" status and other businesses can apply for your brand name. DMS Legal World sends advance renewal reminders and handles the complete renewal process, ensuring your brand stays protected indefinitely.

Assignment & Licensing of Trademark

A registered trademark is a transferable intellectual property asset. You can assign (sell/transfer) your trademark fully or partially to another person or company via Form TM-P. You can also license it to franchisees or business partners through a Registered User Agreement — allowing others to use your brand while you retain ownership. DMS Legal World drafts and files trademark assignment and licensing agreements with the Trademark Registry.

⚠️ 5 Common Mistakes That Lead to Trademark Rejection

Avoid these costly mistakes before filing your trademark registration application:

Descriptive marks: Names that describe the product (e.g., "Fresh Milk" for dairy) cannot be registered — they lack distinctiveness.
No trademark search: Filing without checking existing similar marks leads to objections and wasted fees.
Wrong trademark class: Filing in an incorrect class means your product/service category is unprotected.
Using ® before registration: Using ® symbol before getting the certificate is a legal offence under the Trade Marks Act.
Not responding to objections: Ignoring the 30-day objection deadline leads to automatic abandonment of your application.
Missing renewal deadline: Failing to renew every 10 years causes your trademark to lapse, leaving your brand unprotected.

Common Questions

Frequently Asked Questions — Trademark Registration

What is trademark registration and who needs it in India?
Trademark registration in India is the legal process of protecting your brand name, logo, or tagline under the Trade Marks Act, 1999. Any individual, startup, small business, or company with a unique brand identity should register it. Whether you sell products online, operate a local business, or provide services — trademark registration legally protects your brand from being copied by competitors.
How much does trademark registration cost in India in 2026?
Government fee for online trademark registration is ₹4,500 per class for individuals, startups (DPIIT recognized), and MSMEs (Udyam registered). For companies and LLPs, the fee is ₹9,000 per class. Professional service charges from DMS Legal World are additional and will be communicated clearly before you begin. GST applies on professional fees only.
How long does trademark registration take in India?
The complete process takes approximately 9 to 12 months if there are no objections or oppositions. However, you receive an official application number and can use the ™ symbol immediately after filing. The process includes examination by the Registry (3–6 months), publication in the Trademark Journal (90–120 days), and then final certificate issuance.
Can I register my logo as a trademark in India?
Yes, logo registration (device mark) is fully possible under the Trade Marks Act, 1999. When you file a logo trademark, you can choose to claim it in black & white (which covers all color variations) or in specific colors. DMS Legal World prepares your logo file in the correct format required by the IP India portal and handles the complete logo registration process.
What is the difference between ™ and ® symbol?
The ™ (TM) symbol can be used as soon as you file your trademark application — it indicates that you have claimed rights to that mark. The ® symbol can only be used after you receive the official Registration Certificate from the Trademark Registry. Using ® before registration is a legal offence under Indian law. DMS Legal World ensures you use the right symbol at the right time.
What happens if my trademark application gets an objection?
If the Trademark Examiner issues an Examination Report (objection), you have 30 days to file a written reply. DMS Legal World's legal team prepares a detailed, strong objection reply and, if needed, represents you at a hearing before the Registrar. Objections are common and can be successfully overcome with the right arguments — our team has a strong track record of handling them.
How long is a trademark valid in India?
A registered trademark in India is valid for 10 years from the date of application filing (not the date of registration). It can be renewed for another 10 years by filing Form TM-R and paying the renewal fee. Trademarks can be renewed indefinitely, giving your brand permanent legal protection as long as you keep renewing it.
Do startups get any discount on trademark registration fees?
Yes! DPIIT-recognized startups in India get a 50% discount on government trademark fees — just ₹4,500 per class instead of ₹9,000. MSMEs with a valid Udyam Registration also get the same 50% discount. The discount is claimed by uploading the DPIIT/Udyam certificate during Form TM-A filing. DMS Legal World helps you avail this benefit and ensures the certificate is correctly uploaded.
Can DMS Legal World handle trademark registration for businesses across India?
Yes! DMS Legal World provides trademark registration services across all states in India — Delhi, Mumbai, Bangalore, Hyderabad, Chennai, Pune, Kolkata, and everywhere else. Our entire service is 100% online. You do not need to visit our office. Just share your documents on WhatsApp or email and we will handle the rest from start to finish.
Can a trademark be cancelled after registration?
Yes, under Section 57 of the Trade Marks Act, 1999, any person aggrieved by a registered trademark can file a rectification application (Form TM-O) before the Intellectual Property Appellate Board (IPAB) or the High Court. Common grounds for cancellation include non-use of the mark for 5 consecutive years, registration obtained through fraud, or the mark becoming generic. DMS Legal World handles both defending against cancellation applications and filing them on your behalf.

Your brand name and logo are your most important business assets — and protecting them through proper trademark registration services is no longer optional. It is essential.
